PH Print Terms of Service 

Use of PH Print constitutes acceptance and agreement to PH Print AUP (Acceptable Use Policy) as well as PH Print TOS (Terms of Service). All provisions of this contract are subject to the TOS (Terms of Service) of PH Print and AUP (Acceptable Use Policy). The AUP may be changed from time to time at the discretion of PH Print. Client understands that changes to the AUP by PH Print shall not be grounds for early account termination or non-payment. 

Disclosure to Law Enforcement - (Section 1.1) 
Client agrees that PH Print may disclose any and all client/business information including assigned IP address/addresses, account history, account use and any other information if applicable. Law enforcement will need a written request with further notification after contacting PH Print owner via email regarding the information and why it has been requested. In addition PH Print shall have the right to terminate all services set forth in this Agreement. A request including contact information from the Law Enforcement needs to be sent via contact us page and PH Print will follow up immediately. Price Changes - (Section 2.1) 
Notice to customers that the prices on products or services could change without any notice. Our prices will stay current as much as we can but it may change over a period of time. 

Payment- (Section 3.1) 
While creating an account on PH Print is free you must make sure all your account information and payment information is up to date for billing purposes. All payments are made over Square’s secure payment gateway. 

Disputes- (Section 4.1) 
All billing disputes must be reported within 30 days of the time the dispute occurred. If you dispute a charge to your debit/credit card issuer that PH Print legally charged under the provisions of the TOS and AUP you as a client are still required to pay the invoice in full for the disputed month. If at any given point there happens to be more than one charge on your statement for the product you already paid for (example: payment or system gateway error) then PH Print will refund you the full amount for the extra transaction pending verification. 

Limited Liability - (Section 5.1) 
Customer expressly agrees that use of PH Print is at the customers sole risk. Neither PH Print, its employees, affiliates, agents, third party information providers, merchants licensers or the like, warrant that PH Print will not be interrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the server (godaddy canada) or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through the PH Print Server (godaddy canada). Under no circumstances, including negligence, shall PH Print, its offices, agents or anyone else involved in creating, producing or distributing PH Print be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use PH Print service; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to PH Print records, programs or services. Customer hereby acknowledges that this paragraph shall apply to all content on the PH Print. Notwithstanding the above, Customers exclusive remedies for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, shall not exceed the aggregate amount which Customer paid during the term of this service. PH Print cannot guarantee nor be held responsible for lost files or stolen property. 

IMPORTANT NOTICE - (Section 6.1) 
BEGINNING IMMEDIATELY, anyone editing or using PH Print system without authorized will be IP logged and if the services is used for personal matters regarding hacking, cracking you will be banned from our website and will be denied services pending investigation. 

Account Information and Access - (Section 7.1) 
Users are prohibited from giving out their PH Print account information to others this includes but not limited to family members, friends or unknown parties. if your account information is given out PH Print has the right to suspend your account access until further notice without any acknowledge to the account holder of the suspended account. 

Notification of Violation - (Section 8.1) 
PH Print is under no duty to look at each customer’s user activities to determine if a violation of the AUP has occurred, nor do we assume any responsibility through our AUP to monitor or police Internet-related activities. First violation: Any User, which PH Print determines to have violated any element of this Acceptable Use Policy, shall receive an email, warning them of the violation. The service may be subject at PH Print discretion to a temporary suspension pending a user/company account investigation to refrain from any further violations. 

Second Violation - (Section 9.1) 
Users that PH Print determines to have committed a second violation of any element of this Acceptable Use Policy shall be subject to immediate suspension or termination of service without further notice. We reserve the right, to drop the section of IP space involved in Spam or Denial-of-Service complaints if it is clear that the offending activity is causing great harm to parties on the Internet. In particular, if open relays are on your network or a customer’s network, or if denial of service attacks are originating from your account. In certain rare cases, we may have to do this before attempting to contact you. If we do this, we will contact you as soon as possible. 

Suspension of Account Service or Cancellation - (Section 10.1) 
PH Print reserves the right to suspend the account of the Customer in question and account will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. PH Print reserves the right to amend its policies at any time. Failure to follow any term or condition will be grounds for immediate account termination. You will be held responsible for the actions of your account in the matter described on these Terms and Conditions. Therefore, it is in your best interest to implement a similar or stricter Terms and conditions or otherwise called Acceptable Terms of use policy. PH Print has the right to refuse service to any client or business at any time. 

Indemnification- (Section 11.1) 
PH Print wishes to emphasize that in agreeing to the PH Print Acceptable Use Policy (AUP) and Terms of Service (TOS), customer indemnifies PH Print for any violation of the Acceptable Use Policy (AUP) and Terms of Service (TOS) that results in loss to PH Print or the bringing of any claim against PH Print by any third-party. This means that if PH Print is sued because of a customer's activity or modifications, the customer will pay any damages awarded against PH Print, plus all costs and attorney’s fees. 

Responsibility for Content - (Section 12.1) 
You, as PH Print customer, are solely responsible for the content stored on and served by your PH Print account. 

Customer Privacy - (Section 13.1) 
At PH Print, we know you are the reason we are in business. Our longstanding commitment to safeguarding your right to privacy is the reason for our reputation. At PH Print we will not provide your personal and private information with anyone outside of the team and will not provide or sell your information to any third party company's or affiliates. Refunds - (Section 14.1) 
If you are not completely satisfied with the purchase of your product or service PH Print will offer a reprint of your product at no additional cost to you. If you are still not fully 100% satisfied with your product please contact PH Print via our contact page with your order id, name, address and we will offer a full refund in form of a store credit so you can use towards future purchases. 

If in any time a refund has to be given any PH Rewards Points that has been earned during your purchase transaction will be revoked as part of the refund process.
